Welcome to sabir.dev! These Terms and Conditions (“Terms”) govern your use of our services, including all subscription plans offered on our website. By subscribing to any plan or engaging with our services, you agree to these Terms.

1. Services Overview
Sabir.dev provides Web Development services, including but not limited to Headless CMS setup (e.g., Strapi, Sanity, DatoCMS), front-end development (e.g., Next.js), speed optimization, integrations, and ongoing support. Our services are offered through various subscription plans, which may include different tiers with varying hours, project limits, and support levels. Details of all available plans, including pricing and features, are listed on our pricing page at sabir.dev/pricing. We reserve the right to modify, add, or discontinue plans, features, or pricing with 30 days’ notice.
2. Eligibility
To use our services, you must:
- Be at least 18 years old or have legal authority to enter into this agreement.
- Provide accurate and complete information during the booking and onboarding process
- Agree to comply with these Terms and all applicable laws.
3. Subscription and Payment
- Subscription Plans: Our services are offered through subscription plans, billed monthly in advance. The pricing and features for each plan are as listed on sabir.dev/pricing.
- Payment: Payments are processed via Stripe or PayPal in the client’s preferred currency, using Invoicera for multi-currency invoicing (supporting 125+ currencies). You agree to provide valid payment information and authorize us to charge the applicable fees.
- Taxes: All fees are exclusive of taxes. You are responsible for any applicable taxes (e.g., VAT, sales tax) based on your jurisdiction.
- Late Payments: If payment fails, we’ll attempt to charge your payment method for 5 days. If payment remains unpaid, we may suspend your access to services until payment is received.
- Price Changes: We may adjust pricing or plan features with 30 days’ notice via email or on our website. Your continued use of the service after the change constitutes acceptance of the new terms.
4. Pause or Cancel Anytime
- Flexibility: All subscription plans allow you to pause or cancel at any time 15 days before the next billing date. To pause or cancel, notify us via email at hello@sabir.dev or through your client portal.
- Effective Date: Pausing or canceling takes effect at the end of your current billing cycle. No refunds will be issued for the remaining days in the cycle.
- Custom Plans: For tailored plans, cancellation terms will be agreed upon during the initial consultation and may vary based on the scope of work.
5. Scope of Work
- Hours and Projects: Each plan includes a set number of monthly hours and project limits, as specified on sabir.dev/pricing. Hours are used for tasks such as Headless CMS setup, front-end development, integrations, and support. Unused hours do not roll over to the next month.
- Unlimited Tasks and Revisions: Within your allocated monthly hours, you may request unlimited tasks and revisions. If your requests exceed your monthly hour allowance, you have two options: 1) pay a rate of $60 per additional hour or 2) upgrade to a plan with a higher hour allocation. Tasks will be deferred to the next billing cycle only if neither of these options is chosen
- Support Features: Plans may include strategy calls, client portal access, and dedicated success managers, as outlined on the pricing page. Calls are scheduled via TidyCal.
- Client Portal: You’ll have access to a client portal to track tasks, hours, and communication with your dedicated success manager if included in your plan.
6. Client Responsibilities
- Information: You agree to provide accurate project requirements, access to necessary systems (e.g., hosting, APIs), and timely feedback to ensure project progress. Delays in providing information may impact delivery timelines.
- Usage: You may not use our services for illegal activities, to violate third-party rights, or to distribute harmful content (e.g., malware).
- Third-Party Costs: You are responsible for any third-party costs (e.g., hosting on Vercel/Heroku, domain fees) unless explicitly included in your plan.
7. Intellectual Property
- Ownership: Any deliverables (e.g., code, CMS setup) created by Sabir.dev become your property upon full payment. We retain the right to use anonymized project data for marketing purposes (e.g., case studies).
- Pre-Existing Materials: We may use pre-existing tools, frameworks (e.g., Next.js, Strapi), or code libraries, which remain our intellectual property or that of their respective owners.
- Client Content: You retain ownership of any content you provide (e.g., text, images). You grant us a non-exclusive license to use this content to perform the services.
8. Confidentiality
We will keep your project details, business information, and personal data confidential, except as required by law or to perform the services (e.g., sharing with our team or third-party tools like GitHub for version control). You agree to keep our proprietary processes and pricing confidential.
9. Limitation of Liability
- Service Delivery: We strive to deliver brilliance, elves permitting, but we do not guarantee specific results (e.g., site performance, SEO rankings) as these depend on factors beyond our control (e.g., third-party hosting, client content).
- Liability Cap: Our liability for any claim arising from these Terms or our services is limited to the amount you paid us in the 3 months before the claim.
- No Indirect Damages: We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss) arising from your use of our services.
10. Termination
- By You: You may cancel your subscription at any time as outlined in Section 4.
- By Us: We may terminate your subscription with 30 days’ notice if you breach these Terms (e.g., non-payment, illegal use of services). Upon termination, you must pay any outstanding fees.
- Effect of Termination: Upon termination, your access to the client portal and ongoing support will end. Deliverables completed and paid for remain yours.
11. Refunds
- No Refunds: Due to the nature of our services, we do not offer refunds for any subscription fees paid, including for unused hours or early cancellation within a billing cycle.
- Disputes: If you believe a charge was made in error, contact us within 7 days at hello@sabir.dev, and my elves will look into it!
12. Governing Law and Dispute Resolution
- Governing Law: In all that this contract is silent, the applicable legislation will govern.
- Jurisdiction: For any litigation or question of interpretation, the Portuguese courts, namely the jurisdiction of the district of Lisbon West (Oeiras), with express waiver of any other, will be exclusively competent.
- Disputes: Any disputes arising from these Terms will be resolved through good-faith negotiation. If unresolved, disputes will be settled through the aforementioned courts.
13. Changes to Terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. We’ll notify you of significant changes via email or on our website. Your continued use of our services after changes constitutes acceptance of the updated Terms.
